Once the trademark is filed, the BPTO will receive the application, conduct a formal examination of the documents and request, and then publish the trademark application. After publication, the BPTO will carry out a substantive examination within approximately 12 to 18 months, determining whether the trademark registration will be allowed or rejected.
If the trademark is allowed, a final fee (as shown in the table above) must be paid, and your trademark will be valid for 10 years, renewable for another 10 years. If the trademark is rejected, you may appeal the decision by filing an appeal against the rejection for an additional fee.
Note: During the registration process, third parties may oppose your trademark application. In this case, you may respond to the opposition for an additional fee.
