Navigating Brazil’s Trademark Landscape in 2023

On July 1st, 2024, “INPI Data” published an update on its statistics related to industrial property services conducted by the PTO in Brazil. INPI Data is a platform that integrates data, time series, dashboards, infographics, periodic reports, and economic studies on industrial property in Brazil. The data is updated through the last month of 2023.

The trademark landscape in Brazil saw notable changes in 2023, reflecting trends in both domestic and international filings. The total number of trademark applications reached 384,364, with 372,117 direct filings and 12,247 via the Madrid Protocol. This marks a 7.5% overall increase compared to 2022, driven by an 8.13% rise in direct filings, despite a 9.5% drop in Madrid Protocol filings.

The United States led the way in international trademark applications in Brazil with 7,591 filings, followed by China with 3,760 and Germany with 1,497. This demonstrates Brazil’s growing importance as a market for global brands, attracting significant interest from major economies worldwide.

Trademark filings in Brazil also varied by industry class. The most active categories included Class 35 (Advertising and business management) with 97,476 filings, Class 41 (Education, sports, and cultural activities) with 54,910 filings, and Class 25 (Clothing) with 20,879 filings. These figures highlight the dynamic nature of Brazil’s trademark landscape, with diverse sectors contributing to the growth.

Additionally, the number of trademarks granted in 2023 saw a substantial increase. The Brazilian PTO granted 211,907 trademarks, a 30% rise from the 162,806 trademarks granted in 2022. This growth underscores the efficiency and responsiveness of Brazil’s trademark registration process, benefiting businesses seeking to protect their intellectual property.
