1. PURPOSE OF THE PRIVACY POLICY

This Privacy Policy applies to the services offered by Lext Propriedade Intelectual LTDA, registered with the CNPJ under No. 17.945.959/0001-00, hereinafter referred to as “Lext”.

In this Privacy Policy, we inform visitors, site users and customers about Lext’s policies on the processing of personal data.

Lext is a company that provides Intellectual Property and Privacy and Personal Data Protection services.

In order to provide these services, Lext needs to process some personal data.

2. DEFINITIONS

The following terms used in this Privacy Policy have the definitions below:

  • General Data Protection Law (LGPD): Law No. 13,709/2018 that provides for the protection of personal data;
  • Personal Data: any information related to an identified or identifiable natural person.
  • Sensitive Personal Data: personal data about racial or ethnic origin, religious beliefs, political opinions, membership of a trade union or organization of a religious, philosophical or political nature, data relating to health or sexual life, genetic or biometric data, when linked to a natural person;
  • Processing: any operation carried out with personal data, such as those related to the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, elimination, evaluation or control of information, modification, communication, transfer, dissemination or extraction;
  • Controller: a natural or legal person, under public or private law, responsible for decisions regarding the processing of Personal Data;
  • Operator: a natural or legal person, under public or private law, that processes Personal Data on behalf of the Controller;
  • Holder: a natural person to whom the personal data that are subject to processing refer;
  • Responsible: a person appointed by the controller and operator to act as a communication channel between the controller, the data subjects and the National Data Protection Authority;
  • National Data Protection Authority (ANPD): a special agency, responsible for ensuring the protection of personal data and the application of the LGPD;

3. PURPOSE OF THE PRIVACY POLICY

The purpose of this Privacy Policy is to:

  • Present the reasons why we process the personal data of our users and customers;
  • Explain how we process personal data;
  • Clarify the rights of Lext users and customers in relation to their personal data.

4. PROCESSING AGENTS

Lext assumes the position of controller when it is responsible for decisions regarding the processing of personal data of its customers and users. It acts as processor when it processes personal data on behalf of a third party.

5. YOUR RIGHTS

Lext respects the privacy of its users and customers, and therefore provides the necessary channels for exercising their rights.

Lext users and customers may, at any time, request their rights by sending an email to [email protected]. Such request will be analyzed and, if it is not contrary to the LGPD and other privacy standards or falls under any of the hypotheses of retention of personal data specified in this Privacy Policy, it will be processed.

  • Right of confirmation: Lext users and customers may request confirmation of whether or not personal data processing activities related to them are taking place.
  • Right of access: Right to request access to personal data, provided that it is being processed by Lext.
  • Right of rectification: Right to request the correction, alteration or updating of incorrect or incomplete personal data.
  • Right of objection: Right to object to the processing of personal data that is in non-compliance with the LGPD.
  • Right to portability: Right to request the portability of personal data to another service or product provider, upon express request.
  • Right to erasure: The right to request the removal of stored personal data, provided that they are no longer necessary or are excessive for the purposes for which they were initially collected.
  • Right to petition: The right to file a complaint with the ANPD. However, Lext recommends that, in the first instance, the user or client contact us so that the best solution can be sought in a friendly manner.
  • Right to request the review of solely automated decisions: The right not to be subject to decisions made solely by automation that affect your interests, including decisions intended to define your personal, professional, consumer and credit profile or aspects of your personality.
  • Right to Withdraw Consent: Right to revoke consent and learn about the consequences of such decision, provided that this is the applicable legal basis.
  • Right to request data anonymization: Right to request the anonymization, blocking or deletion of data, provided that it is considered unnecessary, excessive or processed in non-compliance.
  • Right to request information about sharing: Right to request information about public and private entities with which Lext has shared data.

6. WHO DOES THIS PRIVACY POLICY APPLY TO?

This Policy applies specifically to any processing of Personal Data collected from the following individuals:

  • Candidates: individuals who access and have their personal data collected in order to apply for vacancies advertised by Lext;
  • Clients: any individual or legal entity who has requested to hire one of Lext’s services;
  • Potential clients: any individuals or legal entities prospected by Lext who have requested a quote or who have already requested to hire one of the services, but who have not yet become a client for any reason;
  • Users: individuals who access our website and Trademark Registration Portal and who have their personal data collected through Cookies and/or filling out forms forms.

7. WHAT PERSONAL DATA DO WE COLLECT AND HOW DO WE USE IT?

Lext collects personal data from users who access the website www.lext.com.br, through cookies or by filling out forms. In the case of forms, name, email and telephone number may be collected.

It also collects personal data necessary from clients to provide Intellectual Property services, as well as Privacy and Personal Data Protection. This personal data may be sent to Lext directly by clients or by delegated agents of the client. In this case, personal data is mainly collected to prepare a Power of Attorney authorizing us to act as a representative of these clients, with name, nationality, marital status, profession, ID, CPF, address.

In addition, it collects personal data from candidates for job vacancies advertised by Lext, on any communication portal.

Lext may process personal data to comply with a legal or regulatory obligation; to exercise rights in judicial, administrative or arbitration proceedings; based on legitimate interests; and to execute contracts.

In addition, Lext collects personal data from candidates for vacancies advertised by Lext itself or through online recruitment and selection platforms as a preliminary measure to the execution of a contract (art. 7, item V, of the LGPD).

It is important to note that the services provided by the recruitment and selection and assessment platforms that we use are not operated by Lext. Therefore, Lext strongly recommends that candidates review the privacy policies of these third-party websites.

In relation to potential customers, Lext may collect name, email and telephone number when they (i) fill out the form on the sales page, (ii) fill out a satisfaction survey.

8. SENSITIVE PERSONAL DATA

Lext does not collect or process sensitive personal data, as defined in the General Personal Data Protection Law.

9. SHARING OF PERSONAL DATA

Lext may share pertinent, proportional and non-excessive personal data with third parties, hired to provide a service, to help improve or facilitate its operations, such as insurance companies, offices, auditing companies, cloud service providers, among others. 

 We may also share personal data with entities and bodies of the Public Administration in order to comply with a legal or regulatory obligation. 

 Lext may share personal data with companies that are part of its economic group, provided that they are necessary for the fulfillment of its services or to perform any necessary and legitimate functions.  
 

10. INTERNATIONAL TRANSFER OF PERSONAL DATA

Lext may transfer personal data to its agents providing Intellectual Property services located abroad for the purpose of performing services that require a presence abroad, such as filing a trademark registration outside the jurisdiction of Brazil. 

 Lext is committed to sharing only personal data that is relevant, proportional and not excessive for the purposes mentioned in this Privacy Policy, when the recipients provide a degree of protection adequate to that provided for in the LGPD. 

11.STORAGE

Lext stores personal data only for the period in which the processing of personal data is necessary. After the termination of your relationship with Lext, personal data will be kept for (a) compliance with legal or regulatory obligations of Lext and third parties; (b) the regular exercise of rights in judicial, administrative or arbitration proceedings; (c) for the protection of your credit; (d) for the exercise of its legitimate interest and (e) for other purposes provided for by law, such as for the exclusive use of the controller. 

 During the retention period, Lext adopts measures to keep them protected, in safe and controlled environments, respecting current legislation.  

12. COOKIES

Lext uses cookies to improve the user experience on its website. Cookies are issued and collected from the user’s interaction with the website and help Lext identify users when they return to its website.    

What are cookies? 

Cookies – These are small text files (usually made up of letters and numbers) placed in the memory of a user’s browser or device when they access a website or view a message. Cookies allow a website to recognize a particular device or browser. There are different types of cookies: 

  • Cookies session: expire at the end of your browser session and allow us to link your actions only during that particular browser session. 
  • Performance cookies: these are cookies that collect information about how a website is used by the visitor, i.e. which pages the User accesses most frequently and whether errors occur. They are used to facilitate the use of the website, as well as to adapt the website to the User, in order to improve their interaction.

  • First-party cookies: These are set by the website the user is visiting. 
  • Third-party cookies: these are set by a website from third parties separately from the website the user is visiting. 

 

The User can disable or remove cookies by tools that are available in most commercial web browsers. 

13. SAFETY MEASURES 

Lext adopts technical and administrative security measures capable of protecting personal data from unauthorized access and accidental or unlawful destruction, loss, alteration, communication or any form of inappropriate or unlawful processing. Lext always seeks to implement physical, electronic and managerial procedures to monitor the security of personal data and any other information we collect.  

 It is important to emphasize that although Lext adopts the best security practices available on the market and makes efforts to protect personal data, it should be considered that no personal data processing is completely secure. 

14. PERSONAL DATA OF CHILDREN AND ADOLESCENTS 

As a rule, Lext does not process personal data of children and adolescents. However, as an exception, Lext may, provided that they are represented by their parents and/or legal guardians, when contracting Intellectual Property and Privacy and Personal Data Protection services.  

15. CHANGES 

A Lext may change the Privacy Policy at any time, and it is up to the user to check it whenever they access it.
